Tachograph recording sheets: penalty for failure to present is unique

The Ministry of the Interior, with a circular dated June 21, 2021, has adopted the decision of the Court of Justice which establishes that the penalty for failure to present the tachograph recording sheets is unique.

The driver must keep and present, in case of inspection, the discs related to the 28 preceding days. In light of the uncertainty regarding the correct interpretation of the regulatory text, the Court of Justice of the European Union ruled in March 2021.

The Court established that the article 15, paragraph 7, of Reg. No. 3821/85, as amended by Reg. No. 561/2006, and article 19 of regulation No. 561/2006 must be interpreted as follows.

In the event of the driver of a vehicle used for road transport failing to present the tachograph recording sheets or the control device related to various days of activity during the period including the day of inspection and the 28 preceding days, the competent authorities are required to establish a single violation.


Tachograph recording sheets: Circular from the Ministry of the Interior

The interpretation provided by the Court of Justice was then disseminated with the Circular from the Ministry of the Interior. This circular, dated June 21, 2021, will be provided to the competent authorities for road control. This is to ensure the uniform application of the regulation in question that governs the tachograph recording sheets.
