After the clarification circular no. 3834, regarding the changes made by the Mobility Package to transnational secondment , the Ministry of the Interior deemed it appropriate to intervene and also explain the new rules concerning the road cabotage within the territory of Italy.
The Circular no. 6311, after a brief introduction, clarifies the conditions now to be met, and the documentation to have, so that the cabotage carried out in Italy is in compliance with the law.
From February 21, 2022, drivers will not be able to carry out, with the same vehicle and in the same Member State, transports within four days from the end of the last transport of cabotage.
Road cabotage: documentation to be presented
It will be advisable for drivers to always have on board the documentation that certifies:
- the previous international transport;
- any subsequent cabotage transport;
- the transports carried out in the four days preceding the international transport (if during that period the vehicle was within the territory of the same host State).
Also regarding the documentation to be presented, the Ministry specifies that the documentation certifying the international transport can also be transmitted in electronic mode by the company that arranged the transport if contacted by the driver during the inspection. This means that the driver will not be penalized immediately for simply not having the required documentation on board. Only if they fail to have it sent by the end of the inspection will the penalty be triggered. In case of doubt or inability to verify, the agents may request to send the documentation to their Office and reserve the right to verify it later.
As of May 21, 2022, the reduction of the maximum allowable mass of the exempt vehicles from the obligation to possess a community license. All vehicles used for international road freight transport over 2.5 tons will now need to have this license (the previous limit was 3.5t).
